1. Introduction

Welcome to NxVoy (“NxVoy Trips”, “we”, “us”, or “our”). By accessing or using NxVoy’s website, mobile application, or services (“Service”), you agree to these Terms & Conditions (“Terms”) and our Privacy Policy. If you do not agree, do not use the Service.

2. Service Description

NxVoy is an AI-powered platform that allows users to search, plan, and compare travel options (flights, hotels, activities, car hire) and then redirects users to trusted third-party providers for bookings and payments. NxVoy does not process bookings, payments, or ticketing directly and is not a travel agency.

3. Eligibility & Account Responsibility

•You must be at least 18 years old, or have the consent and supervision of a parent/legal guardian, to use the Service.

•You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

•You agree to provide true, current, and complete information.

4. Use of Service

•You agree to use the Service only for lawful purposes and in accordance with these Terms and all applicable laws.

•You agree not to misuse, attempt to gain unauthorized access to, or interfere with NxVoy’s platform, content, or systems.

•You agree not to use NxVoy to infringe the rights of others or submit unlawful, harassing, defamatory, or otherwise objectionable content.

5. Third-Party Services, Data, and Bookings

•NxVoy provides search and planning features and redirects users to third-party providers (such as airlines, hotels, Travelfusion, Expedia, Stripe, etc.) to complete bookings and process payments.

•Bookings are made directly with third-party providers. NxVoy is not a party to any booking, transaction, or contract with these providers.

•Payments are handled via Stripe or the provider; NxVoy does not store or process payment card details.

•Travel data (including availability and pricing) is supplied by Travelfusion and other third parties; NxVoy is not responsible for accuracy or updates.

•Any disputes, cancellations, or changes must be resolved with the third-party provider according to their terms and conditions.

6. Intellectual Property

•All content, software, AI outputs, branding, and designs on NxVoy Trips are the property of NxVoy Labs Ltd. or licensed third parties.

•No content may be copied, reproduced, modified, distributed, or used without prior written consent.

•Users retain ownership of content they submit, but grant NxVoy a worldwide, royalty-free, perpetual license to use it for service provision and improvement.

7. Data Protection, Privacy, and Cookies

•NxVoy is the data controller for personal data submitted by users (first name, last name, email, password).

•Data is encrypted, stored securely, and processed only for the purposes described in our Privacy Policy.

•Cookies: NxVoy uses a “Yes” cookie to manage user consent for GDPR, CCPA, and similar laws.

•Data residency: Personal data is stored in a single region and not copied outside the primary jurisdiction unless required by law or with user consent.

•Payment card data is never stored by NxVoy.

8. User Rights (GDPR, CCPA & Global)

•Access: Request a copy of your data.

•Rectification: Request correction of inaccurate or incomplete data.

•Erasure: Request deletion (“right to be forgotten”) subject to applicable law.

•Restriction/Objection: Object to processing or request restriction.

•Portability: Request transfer of your data to another provider (where technically feasible).

•Withdrawal of Consent: Withdraw consent for processing where applicable.

•Non-Discrimination: NxVoy will not discriminate against users exercising their rights (required by CCPA).

9. Security

•NxVoy implements technical and organizational measures to protect your data, including encryption and secure access controls.

•Data is stored only in a primary region/datacentre (e.g., “UK/EU AWS region”) and is not transferred internationally except as permitted by law.

•Despite security measures, no system is completely secure; users provide data at their own risk.

10. Limitation of Liability

•NxVoy provides the Service “as is” and “as available” without warranties of any kind, whether express or implied.

•NxVoy is not liable for indirect, incidental, special, consequential, or punitive damages, or for losses from third-party bookings or services.

•NxVoy’s total liability for any claim is limited to £100 or the amount paid by you to NxVoy in the past six months, whichever is greater.

•Nothing in these Terms excludes or limits liability that cannot be excluded by law.

11. Changes to Terms and Policy

•NxVoy may update these Terms and the Privacy Policy periodically to reflect changes in law or service. Material changes will be communicated via the website or email.

•Continued use of the Service after changes constitutes acceptance.

12. Termination

•NxVoy may suspend or terminate your access for any breach of these Terms or suspected fraudulent/illegal activity.

•Upon termination, all rights granted to you will cease immediately.

13. Governing Law & Jurisdiction

•For users in the UK/EU: These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of London, UK.

•For users in the US: These Terms are governed by the laws of your US state of residence, unless preempted by federal law; subject to your state and federal courts.

•Where permitted, all disputes shall be resolved by individual arbitration and not as a class action.
